Cuttack: The Orissa High Court Thursday commuted the death penalty for a person in Biswakalpita murder case of Nipania in Tamka police limits of Jajpur district to life imprisonment.
Pronouncing the verdict in the murder of Biswakalpita Behera (16), third judge in the case Justice Debabrata Das quashed the death penalty of Bana Bihari Behera alias Haria given by a lower court.
The judgement of the case was given after a bench of two HC judges had expressed different views. According to sources, Haria was in love with Biswakalpita. However, she repeatedly rejected his advances, enraging the youth to take revenge. Biswakalpita and her mother had gone to relieve themselves in the morning of April 26, 2013 when Haria, who was hiding in the bushes, dragged the girl into the bushes and hacked the girl. The girl died on the spot. Later, the deceased’s father Banamali Behera had lodged a complaint and Haria was arrested. The hearing of the case was conducted at the court of additional district and sessions judge in Jajpur. The court recorded statements of 21 witnesses and on the basis of which handed down death penalty to Haria August 28, 2014.
