Cuttack: The Central Bureau of Investigation (CBI) Wednesday admitted five of its officials entered the residential complex of Orissa High Court judge CR Dash September 19 by mistaking it to be the quarters of judge IM Quddusi, an accused in a corruption case.
The CBI, in its report to Cuttack deputy commissioner of police Akhileswar Singh, claimed that a five-member investigating team led by inspector PK Mishra tried to enter Justice Dash’s residence in Cantonment area.
“We are investigating the September 19 incident. An additional DCP rank officer has verified a station diary in this regard at Cantonment police station,” said a police officer.
The Cantonment police had registered a case against the CBI team under Sections 448, 353, 511 and 34 of IPC. Inspector Mishra and four other CBI sleuths were booked for trespassing into Justice Dash’s house on the basis of a complaint filed by his security guard.
The complainant reported that the CBI personnel had not followed legal procedures while entering the judge’s residence.
Subsequently, the DCP had written to CBI superintendent of police directing him to submit a detailed report explaining the circumstances under which the investigating team entered a sitting judge’s house.
The Orissa High Court Bar Association earlier demanded a fair probe on the entry of CBI officials into the residence of Justice Dash.
The Bar members met Chief Justice Vineet Saran and expressed resentment over the CBI’s arbitrary action insulting the judiciary. Later, DGP RP Sharma and commissioner Khurania met the Chief Justice. The lawyers demanded a probe into the episode by a sitting judge of High Court or Supreme Court. They also sought exemplary disciplinary action against the erring CBI officials.
The Orissa High Court, meanwhile, sought replies from the CBI and other respondents to the case while admitting a PIL in this connection. Petitioner Umesh Chandra Beura claimed that the CBI team had entered the judge’s residence without a search warrant.
