Khimjis file Rs 1.5cr fraud case against Air Odisha

Bhubaneswar: A cheating case against Air Odisha Aviation Private Ltd (AOAPL) and its board of directors was filed before the SDJM court here Thursday for duping a city-based jewellers of Rs1.5crore.
The court directed the Kharvelnagar police to register a case against the company and its directors under section 406, 417 and 420, 506 and 120 (B) (conspiracy) of IPC and investigate the matter.
Petitioners Binod Roy Khimji, managing director of Khimji – KD & Sons Pvt Ltd, and its other directors alleged that AOAPL cheated his company after promising to give 40% of its shares in return of their investment of Rs 1.5 crore into it.
Khimji named Air Odisha CMD Radhakanta Pani and its directors Ashutosh Pani and Santosh Pani as accused in the case for conniving and conspiring together.
Khimjis told the court AOAPL was awarded a government contract to provide inter-state air connectivity. The aviation company, however, needed capital infusion to seal the deal, Khimjis alleged. Air Odisha CMD and its directors persuaded Khimjis to invest `1.5crore in their company and become 40 % shareholders. An agreement, copy of which is in Orissa POST possession, was signed between AOAPL and Khimji & Sons September 5, 2015.
As per the agreement, a joint account was to be opened in HDFC bank and revenue generated out of inter-state air operations was to be deposited in the account. The agreement said 40% of Air Odisha shares will be transferred to Khimji & Sons. The money generated through payment gateway for tickets would be deposited in the joint account.
AOAPL directors, however, opened another account to deposit money generated out of tickets and fudged the company records, Khimjis alleged. Air Odisha CMD Radhakant Pani was not available for comments.
