New Delhi: The Supreme Court has dismissed a review petition filed by Mahimananda Mishra seeking re-consideration of the apex court order dated September 18 cancelling his bail.
A two-judge bench of Justices L Nageswara Rao and Mohan M Shantanagoudar Thursday dismissed the review petition as they did not find any ground in it. The order copy was issued Friday.
“We have carefully gone through the review petitions and the connected papers filed therewith. We do not find any ground, whatsoever, to entertain the same. The review petitions are, accordingly, dismissed,” the bench observed.
Significantly, the apex court had set aside Orissa High Court order of May 2017 granting bail to Mishra.
The top court had said in its order that the Orissa High Court in observing that there was no possibility of the respondent absconding in light of his being a local businessman, not only completely overlooked his past attempt to evade the process of law, but also overlooked the implications of the clout enjoyed by him in the community.
Notably, Mishra had allegedly hired contract killers to murder the branch manager of Seaways Shipping and Logistics Limited, Mahendra Swain, over business rivalry.
According to police, two assailants had hurled explosives on the vehicle of Swain on the morning of October 26, 2016 and when the inmates of the vehicle tried to escape, they opened fire killing Swain. The incident was mainly on account of business rivalry between the company of the deceased and Orissa Stevedores Limited, the company owned by Mishra.
Mishra fled the country after the murder of Swain and only after a lookout circular was issued, was he traced to Thailand and was deported to India, after which he was arrested.
