Cuttack: Dismissing the discharge petition filed by a suspected al Qaeda in Indian Subcontinent (AQIS) operative Abdur Rehman, the Cuttack district and sessions court judge here Wednesday framed charges against him.
Judge Satyanarayan Mishra framed charges against Rehman under Sections 16, 17, 18, 18 (B), 19, 20, 21, 38 and 40 of unlawful activities (prevention) Act and Section 124 (A) of the Indian Penal Code.
The district and sessions judge observed that “there are enough evidences against Rehman. So the discharge petition filed by him challenging the chargesheet is unacceptable.”
The court has posted the hearing of the case to October 24. The recording of statements will begin that day, the court said. Rehman had filed the discharge petition August 10 challenging the charges against him. He claimed that the Crime Branch did not have any evidence against him, hence such framing of charges was mala fide and illegitimate.
Public prosecutor Ajit Kumar Patnaik, on the contrary, opposed the discharge petition and told the court the CB had all corroborative proof related to Rehman’s involvement in terror activities.
“Rehman used to provoke people in the name of jihad. He had been sending youths from Orissa to Pakistan who were nabbed by police later in Delhi. The accused had also visited Pakistan,” Patnaik had informed the court.
Notably, Rehman was arrested in Paschimkaccha in Jagatpur December 15, 2015 and many crucial documents and records were seized from his possession.
