Compensation to minor rape survivor: NHRC seeks report

Kendrapada: The National Human Rights Commission (NHRC) has directed the Superintendent of Police, Jagatsinghpur, and the District Legal Services Authority (DLSA) to submit a report on whether compensation has been paid to a minor rape survivor under the Victim Compensation Scheme. The Commission has asked the authorities to specify the amount sanctioned, the amount disbursed and the date of payment, if compensation has been paid. The compliance report is to be submitted within four weeks, according to an order issued by the Commission Thursday.

The NHRC passed the order while hearing a petition filed by human rights defender Sagar Jena. The case relates to the alleged rape of a minor girl by her neighbour in Jagatsinghpur district on or before August 12, 2025. Based on media reports, the petition sought Rs 10 lakh in compensation for the survivor and an action-taken report from the police.

Taking cognizance of the matter, the NHRC De cember 29, 2025, directed the Jagatsinghpur SP to submit a report. In response, the Additional SP, Paradip, in a report dated January 22, 2026, informed the Commission that a case had been registered at Abhayachandpur police station under Section 64(1) of the Bharatiya Nyaya Sanhita (BNS) and Section 4(1) of the Protection of Children from Sex ual Offences (POCSO) Act. The investigating officer, SI D. Seth, visited the spot, recorded statements of witnesses under Section 180 of the BNS and arrested the accused, Kumar Daloi of Patana. The accused was produced before a court, and a chargesheet was filed on September 23, 2025, under Sections 64(1) and 62 of the BNS and Section 8 of the POCSO Act.

However, the Commission observed that the police report was silent on the issue of compensation to the survivor. In the fresh proceedings August 13, 2026, the NHRC directed the Jagatsinghpur SP and the DLSA to provide details of the compensation sanctioned and disbursed, along with the date of payment. The authorities have been directed to submit the compliance report through the HRCNet portal by Sep tember 20, 2026.
