A PIL alleging that Odisha government violated Supreme Court directions in the Prakash Singh case is being heard by the apex court. Petitioner activist Jayant Das alleges that the State’s proposal to the UPSC, sent on 14.05.2026, included eight ineligible names of Additional DG officers in Pay Matrix 15, though only three officers in DG rank in Pay Matrix 16 actually met the eligibility conditions.
Orissa POST has received a copy of Noting 79 to 104 of OSWAS file No. Home-IPS.PMTN-2021, titled “Appointment of DGP (HoPF),” which is accessible to citizens under the RTI Act. The Home Department has neither denied the file’s existence nor its contents.
The Notings show the Home Department, in consultation with the State Police Headquarters, had identified three eligible officers in Pay Scale 16. It collected their bio-data and clearances from the State Vigilance, Crime Branch and HRPC, and forwarded the three names to the GA & PG Department via ACS Home Hemant Sharma on 16.04.2026 at 6:54 PM. So, the inclusion of the eight ineligible names took place subsequent to 16.04.2026, after Home Department had sent the file to the GA & PG Department.
On 11 March, in Noting 79, the concerned section of the Home Department initiated the process for requesting the State Police Headquarters to send the names of eligible officers for sending to the U.P.S.C. for convening of the Empanelment Committee meeting. This was approved by the ACS Home on 16 March in Noting 83 and sent to the Police Headquarters. The request was processed in the Police Headquarters with the approval of Prateek Mohanty, Additional D.G. and Y.B. Khurania, DGP, and they sent details of the three eligible officers, Dr Sudhanshu Sarangi, Susanta Kumar Nath and Raosaheb Punjabrao Koche on 2 April 2026 in Noting 89. On receipt of the proposal, the Home Department officials examined the eligibility conditions by quoting the UPSC guidelines.
Specifically, lengthy speaking notes are made by Susanta Kumar Moharana (ASO), Harapriya Barik (Under Secretary), Ratikanata Panda (Deputy Secretary) and Trilochan Majhl (Additional Secretary) and the file was submitted to ACS Home on 6 April.
On 9 April in Noting 97, the ACS makes the following observation “What should be the size of the panel to be sent to UPSC, considering that UPSC is supposed to select a panel for recommendation to state government. Please study and put up.”
The file then goes back to the section, and another round of examination is done, and every officer interprets the rule once again to say that there are three eligible officers and therefore three names have to be sent to the U.P.S.C. After thorough examination of the rule position the Home Department forwards the file to the GA & PG Department on 16 April, 2026.
From the Notings it is clear that Home Department had found that the normal zone of consideration shall consist of officers who are holding the post of Director General of Police (DGP) in the State cadre in Level 16 of the Pay matrix, who have six months of residual service. They examine the case of the five officers in Pay Scale 16 and find that Mrs Swapna Tewari was retiring and Sri Vinaytosh Mishra has less than six months of residual service left.
The contemporaneous noting support the claim that an attempt was made to manipulate the pool of eligible officers, deliberately ignoring the views of the State Police headquarters, including then D.G. Y. B Khurania and the Home Department and ACS Home Hemant Sharma.

(c) Further, if no officer of the Level-15 with 30 years of service is available for consideration, the zone of consideration shall consist of all officers holding the post of ADG in the State cadre in Level-15 of the pay matrix and who have completed at least 25 years of service as on the date of occurrence of the vacancy from the 1″ January of the allotment year in IPS. The Committee shall assess all the officers in the zone of consideration.
(d) The officers should have residual service of six months or more from the date of occurrence of vacancy in the post of DGP (HoPF).
It is submitted that the post of D.G.P (HoPF) will fall vacant on 17.08.2026 on account of retirement of Shri Yogesh Bahadur Khurania, IPS w.e.f. 16.08.2026 AN. (4/13/2022.AIS SCAN_20260319_134323601’Page3), the normal zone of consideration shall consist of officers who are holding the post of Director General of Police (DGP) In the State cadre in Level-16 of the Pay matrix as on the date of occurrence of vacancy. The Officers(s) should have residual service of six months or more from the date of occurrence of vacancy in the post of DGP (HoPF). Specific size of the panel to be sent to UPSC by State Government has not been mentioned therein.

The normal zone of consideration shall consist of officers who are holding the post of Director General of Police (DGP) in the State cadre in Level-16 of the Pay Matrix as on the date of occurrence of vacancy. Further, the officer(s) should have residual service of six months or more from the date of occurrence of vacancy in the post of DGP (HoPF).
It is observed that the said guidelines do not explicitly mention the specific size of the panel to be sent to UPSC by the State Government.
As per the said guidelines, only 03 (three) IPS officers in the grade of DGP, having completed 30 years of service as on the date of occurrence of vacancy, i.e. 17.08.2026 are eligible for consideration for selection to the post of DGP (HoPF).
However, the number of officers to be included in the Panel of UPSC shall not exceed 03 (three). The panel may, however, consist of less than 03 (three) officers in exceptional circumstances for reasons to be recorded in writing.

However, there is no mention about specific size of the panel to be sent to UPSC by State Government in the said guidelines.
Thus as per the said guidelines, only 03 IPS officers in the grade of DGP having completed 30 years of service as on the date of occurrence of vacancy i.e. 17.08.2026 are coming within the zone of consideration for selection to the post of D.G.P. (HoPF).
In view of the above, it may be considered to endorse the file to the GA & PG Department for taking further course of action at their end as proposed at Noting No. 96.
