Bhubaneswar: The civil judge’s court has granted one-fifth share of land to the daughter of its original owner after the land was sold by the owner’s sons to a construction company.
Bishnu Priya Swain (30), of Khandagiri at Khurda, alleged that after the death of her father, Golak Chandra Swain, her siblings gave one Jagabandhu Routray power of attorney over his property. Routray then sold it to a construction company without her knowledge.
Bishnu Priya contended that her siblings — Bijay Kumar Swain (43), Basant Kumar Swain (34) and Rajalaxmi Swain (24) — sold her share of the land as well and claimed rights on the land where the construction company, Sri Krishna Estate & Construction Pvt Ltd, has started building a house.
The company opposed Priya’s claim on ground that she was not related to the late Golak Chandra Swain and thus has no right over the land. Bishnu Priya then produced her voter ID card, school certificates and other documents as proof of her relation to Golak Chandra Swain.
The court observed that the other three siblings did not contest her claim to be the daughter of the late Golak Chandra Swain and the construction company could not prove that there were two people with the same name in Jagamara area of Khandagiri. It thus accepted Bishnu Priya’s contention that she is the daughter of Golak Chandra Swain.
It, however, found the sale deed between the construction company and the siblings valid.
The court then passed an order that one fifth of the land shall be taken away from the construction company and given to Bishnu Priya as she has legal right over her share under the Hindu Succession Act.
