Bhubaneswar: A woman of two children was granted rights over a landed property inherited by her husband on grounds that her son and daughter shall inherit the property under Hindu Succession Act by the additional district judge cum special judge CBI-II here January 25.
Setting aside a lower court order, the court said the woman and her children can share the inherited property of her husband and the husband cannot overlook this fact while selling the property to a third party.
Sujata Panda (33) of Kulasahi in Balianta in Khurda district pleaded that her husband Premananda Panda (45) had inherited a 12 decimal land in Mouza Prataprapur from her father-in-law Pranakrushna Panda in 2004.
Sujata pleaded that her husband, a drug addict, had sold the land to Umakanta Panda (51) of Kulasahi in 2006. She alleged her husband sold it without their knowledge and she and her kids have a right over the landed property which cannot be taken away from them.
Although the court found the sale deed between Sujata’s husband and Umakant Panda, it recognised Sujata and her kids’ right over the property.
The court observed that the relationship of Umakant and Sujata’s family will be that of purchaser and legitimate owner and until a legal remedy is found out, Umakant cannot move Sujata and her kids out of the house. PNN
