New Delhi: The Supreme Court (SC) will hear a petition filed by Sundargarh ex-MLA Jogesh Kumar Singh challenging the Orissa High Court’s order of declaring his election null and void February 5.
A two-judge bench of the apex court comprising Justices AK Sikri and S Abdul Nazeer would hear the case.
Earlier, January 15, the SC had deferred the hearing after the counsel for appellant sought time to file rejoinder on the counter affidavit filed by respondents.
It is to be mentioned here that the Orissa High Court had declared the election of the ex-MLA from Sundargarh, which is reserved for Scheduled Tribe candidates, as null and void January 30 last year for the suppression of facts.
Jogesh had approached the apex court in the matter which gave him interim relief February 13 last year by imposing a stay on the Orissa High Court’s decision to dismiss him from Sundargarh Assembly constituency.
Recently, Jogesh has resigned from the primary membership of Congress and the post of MLA after he was suspended following the recommendation of disciplinary committee of the party.
